: My understanding is that under current law tenants have 90 days and former owners have 60 days to vacate after the trustee sale. Or I guess more accurately after perfection of title 10 days later or so. My question is this: although one can't evict, can one move in? If they don't have a leasehold (I'm assuming the former owners live there) and they are not the owner then what rights do they have other than eviction? Can I park my car in the driveway? Pitch a tent in the backyard? What law applies under this circumstance?

When you record your trustee's deed, you do not obtain the right to possession of any part
of the property. If you enter an occupied property prior to legally obtaining the right to possession, you are tresspasing.
