One is the use of a cooperative option and another is the sub3 method you can get the secret to for $400 I think. With your method do not find the tenant buyer first, at that point your not acting as a principle in the transaction but intending to earn a fee/commission and are not exempt from the licensing requirements. As a matter of fact if were an attorney looking for business I would search out these deals and get the clients illegal commission back for them and collect attorneys fees to make it worth my while. Even with finding a lease-option seller first I have heard some rumblings coming out of Sacramento that seems to suggest the DRE is looking at these deals and if a investor shows a pattern of not staying in these deals for awhile and assigns his interest to the tenant buyer or even back to the seller quickly they may argue the investor had no intent to be a an actual principle and are merely using this method to disguise the real activity which is acting without a license for a fee. You can find a seller willing to lease-option and go the traditional sandwich route and maybe modify it somehow such as giving the tenant-buyer an option to buy out your lease-option after some period of time where you show intent to be in the deal for more then a minute as a principle. I actually typed a very long response to this with a variety of answers but when I went to preview I wanted to add a few words to clarify one point and when I hit the back button everything disappeared, this has happened before, does anyone else have this problem or is it something I'm doing?
