Shea and Warda suggest using a contract for option in order to avoid creating an equitable interest of the tenant-would-be-optionee. I think that using options to tie up and acquire property is a sound concept. CA investors should be particularly cautious about using option devices with end user buyers. You would be well advised to find some other investors who have been doing what you plan on successfully for an extended period of time and follow their lead. Also, you might want to find what other means would get you to the same place. I'm not so sure that you're going to find many people who had 3% to put into a deal that will go along with your program, but it's certainly worth a try.
