If you are doing a "full escrow" don't prepare any docs, just submit your sales contract to escrow. You will need a certified copy of the death cert so that escrow can prepare an affidavit of death of joint tenant. I always suggest that you stay away from preparing your own docs. Escrow will prepare the docs in such a way that they are willing to insure title now and in the future. That's what escrow is for.


: I have a seller ready to do business. My question (and I searched the archives already):

: Title currently shows husband and wife as: Dan Beatle Juice and Beatrice Juice, husband and wife as Joint Tenants.

: I want to create a deed to transfer the property to a trust so I can take over the property sub2 the current lien. I don't know what to write on the new grant deed. Do I put Beatrice Juice, Widow after her name?

: I am going to have her sign a purchase and sale agreement for $1 more than the loan amounts and do a full escrow, but I want to capture the equity.
