According to our credit report the second mortgage took a write off. Does that mean we could sell for the amount of the first and be done with the property? Maybe the bank would consider a short sale considering the circumstances? : Thanks for the reply. I have an appointment to speak with an attorney tomorrow morning about it. I have a Pre-Paid Legal type (not PPL) service through my work. We'll see what they have to say. : The total amount due is $2,012.52 an includes dues and late fees for several years. : As to why the original lender didn't foreclose, there is absolutely no telling. The servicer was / is EMC Mortgage Corp. I am pretty sure they were a major player the collapse, so I'm sure they were in some state of disarray. : We had worked out an offer to purchase with an investor, but when we presented it to EMC Mortgage the informed us that it was too late and that the property was already scheduled for foreclosure. : We confirmed the notice of foreclosure in the legal papers, confirmed with the attorney that was handling the foreclosure sale. I didn't know there was any possibility they would not follow through with the foreclosure. : Thanks for the advice. : Melissa
