If the HOA obtains a judgment against you they can attach it to any property you own. However, HOA/condo fee laws vary from state to state, so you should check with an attorney to see if they are any limitations on HOA delinquent fees. In most states HOA/condo assn are limited to the number of months of deliquent fees they can collect from the successful bidder. I presume that any overage is the previous owner's responsibility. Without knowing GA's law I'd suggest waiting for the smoke to clear and then offer to compromise before an attorney/collection agency becomes involved. They could be playing a game of chicken, but you have the most to lose. Why did the lender not foreclose? Did you take bankruptcy?
