: Hello, My situation is different than most renters in foreclosure. as I am renting a room from the homeowners. So a renter and the homeowner both live in the house. They are going into foreclosure. I have 2 questions

: 1)will the 60 day period to stay after the home has been auctioned apply to me? or it wont since i am only renting a room and not the full house, pluse the homeowners live here too?
Yes BUT you must respond in court to their service. Beware, they often do what is called gutter service. Or the service appears to be only to the person on the loan.
You will have 5 days to respond.
If you find out who the new owner is, you can check the court each week for filings
See the rental contract (you have lived there for more then a year) is binding against the new owner.
Have a response ready to run down to the court, there is help on the internet how to do this.
"I have lived there for X years, and am entitled to 60 day change in tenancy. Since this was not provided, this filing is invalid" or however it is worded.
: 2) The home was supposed to be auctioned back in december, everytime it is supposed to be auctioned, the homeowners call and request for it to be postponed, it than gets postponed for a month or so and than they do it again. How many times can they request the auction to be postponed? Also someone left a note on the door with all the auction info, i can go onto priority posting and see when the house will be auctioned, it says it will not be auctioned untile next month, yet the homeowners are telling me the house has been sold already.
Until the lender gets tired of it and just sells it at Auction.

: I am in california in the inland empire.

: 1 more question, I am a student and cannot afford much rent. I was wondering if I would be able to rent a house for cheap while its on the market, if it sells I can move out. Basically I could provide house sitting services and cheap rent until the house sells?

How do I know...I had a house with dirty title that was better going back to auction.
So they did the gutter service on us.
