I don't agree with everything you said, but you brought up some interesting points. As most often the prospective is from a CA viewpoint and some of your points may be very valid in CA, but we don't even know if the property is located in CA. More detail from the original poster would lead to less assumptions on everybody's part. This is akin to a doctor diagnosing a problem via telephone. While CA does have its idiosyncracies, my prospective is national in nature. Regardless of how the issue is resolved it probably should have been resolved beforehand or maybe they are trying to resolve it before marketing. In any case it reinforces the belief that we're probably dealing with a newer smaller servicer. In my world a clean title was a relatively rare occurance and it was rare that a clouded title issue couldn't be papered over. Most of the problems were from a lack of understanding by the title officer, an overly conservative viewpoint, or it was just expedient to make an exception and sort out the details later. Almost any title company is decent at the routine transactions, but clouded titles & surveys separate the men from the boys.
