I assume that this is a REO under contract with the lender. Lenders have to give marketable title, so it's their problem. I'd call your lender directly and advise them of the problem (if they aren't already aware of it). Let them and (presumably your title co) resolve it. You could research the pending lawsuit for more background, but it's not really necessary. Maybe their title company (or another one) would be willing to insure. If so, they can give marketable title and you use their title co. From the brief facts stated it doesn't appear to be anything out of the ordinary in cleaning up titles.
