I learned this trick from a middle-eastern arms trader that joined me on a skiing trip to Switzerland or somewhere, many years ago. He definately knew how to play both sides (whew!). However, you'd better treat this one like a glass sword, and handle this one very carefully, Sir. Seller thinks they have a great case and may be cocky about that. Lender thinks the borrower is a flake and is just stalling for time. What you may have is a fact pattern that is very different such as questioning the authenticity of the loan doc signature(s), or the competency of the borrower (like Grandson talks Grandma into getting a loan so that Grandson can finance his [fill-in-the-blank]. THese are real cases and ugly. I see my fair share but fortunately, I'm not privy to the problem; only to the solution. You'd better truly understand what's going on here because you really need to know that nature of each party. Then, you need to be there at the pricise time that a given party is really sick of the whole darn thing: Lender is tired of pouring money down the gullet of this borrower; borrower is loosing hope that this case will ever settle (such as when someone's likely lifespan is maybe too short to see the benefits). One approach that I like is to be a loan mitigator and become the collectin agent of the lender (although we don't regularly service other lender's debt). This is not for the inexperienced, nor the "Loan Mod," "Short sale" or whatever biz-op d'jour folks are flocking to this week. Getting in the middle of litigation definately takes the skills, energy, capital and stamina of an alligator wrestler. It's not the alligator's mouth that worries me most, either. The Crodile Hunter may have shown us how to sex a croc, but I've never wanted to get close enough to look that closely. So, be careful. And, be sure that you really ENJOY this kind of deal because if you don't, you'll regret being in the reptile pen, regardless of their genders.
