I suspect that the lender might postpone the TS. If they don't that may tell you something about what they think their chances are for prevailing, but I think most would automatically postpone the sale (assuming it's an institutional lender). In some states 12-18 mos could be relatively fast to cure a title problem. Just depends what it is. I can't imagine any foreclosure sale being bought so cheap to adquately compensate for the known risk in this case. Private sale yes, foreclosure no. This is an individual thing depending upon what one considers a good deal. There are too many TS out there to take the risk.
