3 day or 60 day???

Posted by Lughead on May 05, 2009 at 5:24 PM

Hello

In CA ...

trustor dies

Home goes to Trustee Sale.

occupants are the descendants of the former trustor

is a 3 day notice appropriate since they are relatives of the former owner?

or a 60 day notice ... even though they are not paying anyone and do not have a rental agreement?

rather than merely suggest a 60 day out of abundance of caution ... please include your thought process in the answer and any code section you think would be germane ...

Rick or others - are there any probate related landmines that might be lurking or are they non-issues as the foreclosing deed of trust is prior to the date of death?

thank you in advance for your thoughtful insights
