Otherwise, I can't think of any reason not to be straight-forward about your concern(s). As a matter of fact, I can't see any tangible benefit to you, as a buyer, to walk around the 'elephant in the living room' (referring to the foreclosure problem). If anything, if the agent is still in the dark about the default, they ought to be really receptive to trying to persuade the owners to become motivated sellers. As for the auction being called off, that isn't likely to happen unless the lender agrees to do so, absent the seller taking an affirmative action to stop the sale via reinstatement, a legal stay, etc. If you really want to purchase this property, then make a follow up call to the listing agent. I would suggest that it best to discuss the seller's default verbally so that the agent doesn't feel that s/he is somehow divulging confidential info about the client. Also, pre-foreclosure means that no action has been taken by the lender. If the foreclosure sale date has been set, then they are in foreclosure (not unlike pregnancy, can't be a little bit in pre-foreclosure).
