Re: Post trustee sale evictionIn Reply to: Post trustee sale eviction posted by Bob (CA) on April 24, 2009 at 10:48 AM What city is it in? There are some eviction moratoriums in place in some cities for renters, even for properties without rent control. As in you can't evict them....in LA (for now) and some cities in the Bay Area. If that's not the case, I'd strongly, strongly suggest cash for keys. As in real cash. I think the convenience of getting the property asap is worth a couple of thousand dollars. FYI: there's is a lot info sites and blogs available to tenants on the internet these days regarding being the victim of foreclosure, esp. in CA. The average tenant knows way more of their rights than in times past. Tread carefully.
: A 3 day notice was served on a former owner post trustee sale and then we received a call from someone that states they reside in the property as a renter. (When we knocked the door after the sale, the occupant stated she was a renter however when we obatined her name we determined her to be 1 of the former owners) We have been in the eviction process from some time and now reveive a court filing stating that we did not give the proper 60 day notice to the renter occupants. : My question is: If a former owner resides at a property and someone in the property claims to be renting a room at the same property, do we then have to start the process over and give a 60 day notice? : Bob
