Post trustee sale eviction

Posted by Bob (CA) on April 24, 2009 at 10:48 AM

Ward,

A 3 day notice was served on a former owner post trustee sale and then we received a call from someone that states they reside in the property as a renter. (When we knocked the door after the sale, the occupant stated she was a renter however when we obatined her name we determined her to be 1 of the former owners) We have been in the eviction process from some time and now reveive a court filing stating that we did not give the proper 60 day notice to the renter occupants.

My question is: If a former owner resides at a property and someone in the property claims to be renting a room at the same property, do we then have to start the process over and give a 60 day notice?

Bob
