Anonymity of ownership...

Scott,

The Title Holding Trust's claim to fame is the protection that privacy or anonymity of ownership provides.

But once your anonymity of ownership is breached you would have no personal asset protection.

So you might consider forming one LLC in the state where the properties are located and make it the beneficiary of the two different trusts you'd form to take title if no one bids more than your opening bid at your foreclosure auctions.

: I have two out of state mortgages that I am foreclosing on and I would like to know if there is any benefit (from a liability standpoint) to putting the properties into a THT. I would use a 3rd party professional trustee, 3rd party property management and purchase liability insurance. If there happened to be a lawsuit regarding the property, could I have any personal liability as the Beneficiary of the THT? I plan to hold the properties for a year or two and I would prefer not to set up a separate LLC if it's not necessary.
