AZ codes, etc.In Reply to: arizona posted by mark ackrich on April 19, 2009 at 0:08 AM Mark, You will find Arizona's foreclosure laws detailed at: Arizona Revised Statutes §§ 33-741 to 33-749 and 33-801 to 33-821 AZ's non-judicial foreclosure schema does not involve a default phase. Therefore there are no Notices of Default (NOD) regarding their foreclosure procedure. What they do record at the onset of their formal, non-judicial foreclosure process is a Notice of Sale (NOS). The soonest any foreclosure auction of the secured real property can take place is ninety days from the date the Notice of Sale was recorded. Besides recording the NOS, it must be published in a newspaper at least once a week for four consecutive weeks and posted on the property twenty days before the sale and sent to the owner of record by registered or certified mail. The Trustee’s Sale can be conducted on the property being foreclosed upon, or at the local Superior Court building, or the Trustee’s office building. One foreclosure notice service I can give you is the Foreclosure Update & Newsletter @ (602) 892-9401. You might ask them for a newspaper reference regarding the published notices.
