Does a THT provide any liability protection?

Posted by Scott on April 20, 2009 at 1:14 PM

I have two out of state mortgages that I am foreclosing on and I would like to know if there is any benefit (from a liability standpoint) to putting the properties into a THT. I would use a 3rd party professional trustee, 3rd party property management and purchase liability insurance. If there happened to be a lawsuit regarding the property, could I have any personal liability as the Beneficiary of the THT? I plan to hold the properties for a year or two and I would prefer not to set up a separate LLC if it's not necessary.

Thanks, Scott
