Re: Served 3-Day Notice Before I Received the DeedIn Reply to: Served 3-Day Notice Before I Received the Deed posted by Mistake In CA on April 11, 2009 at 6:05 AM hello read the other posts and agree ... record the deed when it comes and re-serve from personal experience ... the former owner would need to file a lawsuit for wrongful foreclosure ... at that point, i'd suggest you see about having the sale rescinded and get your money ... unless you are ready for a long drawn out ourdeal and a lot of attorney fees and wasted time, you may just want to go to another deal also sounds like you now understand that just having served the notice prior to recording the trustee's deed does not invalidate the sale ... the days between the sale and recording the trustees deed are in my opinion a grey area of no mans land ... you own it but you dont oficially own it live and learn take ward's class good luck Follow Ups: Post a Followup:
