Melody keeps returning to the issue of her deceased cousin and his younger Brother's concern about liability for the debts. If there is a way to turn this around (at least about the property) the younger Brother may wish to do something with the property, but certainly on a voluntary basis and only if he sees the merit and benefits of curing the loan and/or selling the property. There is NO probate issue that I can see here. AS to the language as a "defendant," if the NOD was prepared by an attorney/foreclosure company that routinely handles cases outside of Calif., they may have inadvertently identified the trustor as the defendant, as they may do in some judicial foreclosure states where it's a two party process. That's my best guess. See you Saturday.
