The 2.5 acres comes from AZ statue 33-814 section G that states "If trust property of two and one-half acres or less which is limited to and utilized for either a single one-family or a single two-family dwelling is sold pursuant to the trustee's power of sale, no action may be maintained to recover any difference between the amount obtained by sale and the amount of the indebtedness and any interest, costs and expenses." And as far as the tax consequences of the foreclosure and the debt forgiveness, the President signed HR 3648- The Mortgage Forgiveness Debt Relief Act of 2007. It prevents any forgiven debt from from being reported as income. However, in my own research, I have only seen that this applies to short sales. I have not been able to confirm that foreclosure sales fall under this same protection. Hope this helps though! I am in a similar situation in Phoenix and that's how I know this. Bought a house in 2005 for 225K on an 80/20 ARM that is about to adjust. Can't refi because house is now only worth 165K. I'm still researching!
