Suntrust and Deficiency Judgments - Virginia

Posted by Virginian on May 08, 2008 at 8:41 AM

Anyone know what Suntrust's current mood/policy is regarding deficiency judgments in Virginia? We're a non-judicial foreclosure but the shortfall could be low 5-figures so maybe it's cost-effective to go after a DJ under seperate legal action? Unlimited DJ's allowable in Va, 5-year statute of limitations on pursuing one. Our guess is that the bank will have to hold our house for at least a year to find buyer, maybe more based on regional supply.

For the record Hope Now has recommended us for a re-structure. We're waiting for feedback right now from Suntrust. Time is of the essence.

thx for any help.
