I've seen some pretty dead-wrong opinions here so please, take anything you get here with a grain of salt. Since you've got a $100K discrepancy and this is the roof over your head, it's time to spend the money and get good, qualified legal help. You mention this is a CA property but not where, so what I'd do is hire one of the law firms/attorneys that the lenders and foreclosure trustees use. Rande Johnsen of Trustee Corps always suggested that I hire my enemy in such matters. Then, upon having someone that the lender or their loan servicer WILL listen to, you can get your questions answered. I would make a wild guess that you'll need to pay this attorney for about 3-5 hours of his/her time. Get very organized before your app't and ask your questions from your notes, avoid idle chatter, and get to the point immediately. Debating is fine if you feel like paying the attorney to debate with you. He or she might enjoy that, at about $350/hour.
