Priority for amended deed of trust

Posted by Charles on May 05, 2008 at 1:19 PM

Hi Ward & others,

I remembered this was discussed before and Ward has concluded that amended trust deed will use the new recorded date to count its seniority. But I couldn’t find it. Just reconfirm here.

2/3/2003: TD ($50,000)
5/14/2005: FTB lien ($160,000)
6/3/2007: Amended of trust deed (increase 2/3/2003’s TD to $100,000).

So in this case, FTB lien is senior to 2/3/2003’s TD, correct?

Thanks in advance,

Charles
