Second mortgage holder in Florida

Posted by Louise on April 24, 2008 at 6:25 PM

I issued a second mortgage to the buyer of my house in Florida. The borrower/buyer has paid me off and I haven't gotten around to filing a Satisfaction of Mortgage yet. However, the first mortgage holder (bank) has just recently filed a Lis Pendens against the buyer of my house in preparation for foreclosure and the first mortgage holder (bank) has listed me as a defendent in the Lis Pendens. Does that mean that the First Mortgage holder (bank) can come after me for monies paid to me by the buyer? Why would the bank list me as a defendant? Is it too late to file a Satisfaction of Mortgage?
