That's understandable, especially if you're just checking this site out before you put you toe in the water much further. However, you've got your facts incorrect here and you really ought to get a better handle on that first. In CA, there is no "Notice of Foreclosure" but rather certain other notices. A review of the CA foreclosure process and the noticing and documents involved would help tremendously. You can begin by reviewing the foreclosure code from the links on the left. Also, if you're in the SoCal area, attend one of the events that Ward occassionally speaks at and you're feel much more comfortable with the topic. Your post innocently touches on lots of topics (equity purchase statutes, lender rights, howeowner rights, due-on-sale laws, etc. If you're referring to the "Notice of Trustee Sale" which starts the publication period, I wouldn't automatically assume anything about what a lender -- or, for that matter a property owner-- will do or accept. The civil code (and some case law) are the last words on what is legal and the rights of each party. There are oodles of other things to consider here, in fact, too many variables to know what the lender will do. Want to do a cash for keys deal? Better use the right documents and know the laws, especially rescission rights of the property owner. And my post wouldn't be complete without strongly suggesting that you take Ward's 3 day foreclosure training course.
