Is a person buying a home that is more than 3.5X the household income?
Is the person READING the loan docs before signing?
Is the person knowingly getting an ARM or loan that is anything BUT a 30 year fixed?
Does the person ask any questions during document signing.

Sorry. Not buying the whole "I was duped and didnt know what I was signing" argument.
You bought a house that was WAY over your head, you thought the market could only go up, now you are left holding the bag and looking to shift blame to someone else.

: Hello Jimbo,

: If a person doesn't overstate their income and other info on the loan application and the loan later adjusts and they are then faced with a payment that they cannot afford then that would be a good example of predatory lending which is illegal.

: If a person does overstate their income and other info then that would be loan fraud which is also illegal.
