Regardless of whether the homeowner has any equity or not, Civil Code Section 1695 requires the use of forms containing special language and a Notice of Cancellation if the buyer has no intent to move in and use the premises as their principal residence.

: When buying a home from an owner that is in pre-forclosure, here in California, if there is no equity in the house and we are going to negotiate a short sale with the bank, do we still use an EPA or can we use a regular purchase agreement?
