The claim is a big problem but for the estate not you. In retrospect the key was the probate court file, as I doubt if you would see a title report in a probate file. CA must be diligent on tracking deaths to potential claims. Your problem is can your ultimate buyer/lender get title insurance? You need to run this by several title insurance companies. Your safest bet is probably to bring up the discrepancy to the trustee and see if they restart the foreclosure. Chances are they will.
