NTS recorded as Trustee's Deed

Posted by Dan on April 11, 2008 at 4:22 PM

Property in California had a Notice of Trustee Sale recorded as a Trustee's Deed. I noticed this as I have been tracking this specific property through NOD and noticed today on the grantee / grantor index that a Trustee's Deed was recorded against the trustor.

After I picked up my heart from the ground I realized this could not be... I went to the recorders to review the document and sure enough it is a notice of trustee sale recorded as a Trustee's deed.

Newpaper publications and anybody searching Notice of Trustee Sales will not see this item.

Could this be deemed an illegal sale As it was not recorded as a Notice of Trustee Sale?
