Post sale possession routine...In Reply to: notice to vacate posted by hard money lender on April 09, 2008 at 9:58 PM HML, It is up to the winning bidder to perfect their possessory interest to the foreclosed property they bought. So after recording his trustee's deed, he can serve a 3 Day Notice to Vacate (due to foreclosure) on the ex-owner in residence. If the ex-owner doesn't comply, the winning bidder could then proceed with an Unlawful Detainer action and evict the ex-owner.
