Yes. That's part of the little game that's played. Even if trustor fails to notice bene of foreclosure trustee of the BK and as long as it's determined that it was a valid BK filing, you have a blown sale. Blown sale, because it was conducted, requires re-pub for NTS only.

BTW, this is why I'm not often Mr. Nice Guy when boprrowers ask for more time. They have a bad habit of rewarding me for trying to be helpful.

If --on the other hand-- I am in regular contact with a borrower prior to the sale, I'll sometimes negotiate a forbearance agreement (extra time) for additional consideration, which may be tacked on to the loan's U.P.B. I'm starting to get more creative in this area.
