Innovest Resource Management BBB Business Review

Notice to primary lienholders

November 19, 2021 08:56AM
Hello All,

I funded and recorded a loan as a second TD and I am positioned well considering the total LTV. Payments on my subordinate lien are current and have always been on time. I also regularly monitor the title activity to make sure the first TD is being kept current. The owner has also recently place a third position TD

My concerns/questions are:

1. Should I give formal notice to the first and third TD holders of my lien? Does anybody have a sample of what this notice looks like?
2. Does the primary lien holder have a legal obligation to inform me of default if I don't give them formal notice of my recorded lien?

Thanks so much for any insight given.
