            <description><![CDATA[ I hope this is appropriate for this forum. If it helps, I took Ward's Title Holding Trust private classes around 2003-2004. This is not a foreclosure question, but it is a title question.<br />
<br />
Here is the scenario:<br />
<br />
1. A pastor and his wife own a property in a living trust, &quot;<i>John Smith &amp; Carol Smith, trustees of the Smith Family trust, dated 10/25/2000</i>.&quot;<br />
2. On 9/14/18, they transfer title to a different trust, &quot;<i>John Smith &amp; Carol Smith, trustees of the Majestic Trust, dated 10/25/2000</i>.&quot;<br />
3. The property is then refinanced on 10/12/18, by '<i>Majestic Trust</i>'.<br />
4. The property is then transferred back over to the '<i>Smith Family Trust</i>' on 10/27/18.<br />
5. I assume that both trusts were created on the same day in order to work together to achieve some purpose.<br />
<br />
What just happened? Why the quick transfer out and then back in the family trust? <br />
How could the fact that he's a pastor as opposed to anyone else change why he's doing it this way?<br />
If the wife is not a pastor, does that change anything?<br />
Could the property really be owned by the church? Could this be a way to funnel money to the pastor and not pay taxes on it?<br />

Get letter today asking me and my wife to appear in some foreclosure conference for my old home that is owned by someone else. The claimed secured debt company none of us are aware of even new homeowners. Wouldn’t this be revealed at settlement before closing? <br />

            <description><![CDATA[ Hello and thank you for taking the time to read my post today. I am using my speech to text on my cell phone so please forgive any grammatical or spelling errors. I am a single mother of my 11 year old son we have a home in Oklahoma a home  which I took over May of 2022. It was my mother's home she passed away from cancer.. Trying to juggle two residences, and falling into a depression after my mother passed I fell behind on my mortgage payments on Mom's house. The last mortgage payment that was made was in August. I have stayed in constant contact with the mortgage company. I decided after giving it much thought to go ahead and sell mom's house and property. I got the payoff balance on the mortgage to pay the loan off and it's $68,000. I am selling for sale by owner as is at a lesser price there are some repairs that are needed and I just haven't had the funds to take care of those things. I have a buyer on the house she is willing to pay my asking price which is $140,000. I'll be able to pay off the mortgage loan and pay any attorney fees or closing costs anything like that I'm a novice at real estate this is my first time owning a home and selling a home. So I'm very nervous trying to locate a real estate attorney. There is a real estate investor in Texas who has been walking me through the process. I have been depending on selling the home so that I might be able to relocate my son and I and get us another home with the money from selling my house last Friday I received a summons in the mail on foreclosure stating that I have 20 days to respond. I immediately contacted the mortgage companies attorney to let them know I do have a buyer and that the buyer already has been pre-approved on the loan for the house. I called the mortgage company they told me I needed to get proof of funds and get the contract signed as soon as possible and then have it emailed over to them. I have of course the title I'm just afraid there's going to be some problem in that department. I just want this to get done fast and I know it's a process I'm just not sure really which title company to go with I need to call and check and see if there's anything on the title that would cause problems time is of the essence we don't have much time to do anything. Just to include this the taxes have been paid every single year as well as the mortgage up until I took over in May of 2022 I stopped paying on the homeowners insurance when I decided to sell the home which was stupid I'm sure. I am not wanting to keep the house I  am wondering do I still have time to sell the house? The papers that I was served states that I have 20 days to respond it was addressed to myself , my sister Sabrina and to also my mother I really hope I can still sell the house that is really my son and I only hope at getting a new place.I'm doing much better today I am in therapy and I'm on antidepressants my mother and I were very close we were best friends I miss her dearly and I really struggled with her passing. I did go ahead and move into Mom's house I'm hoping to be out by the end of July the buyer absolutely loves the house she says there's no question whether or not that's the house for her.  so please tell me what do I do next ? what is priority right now? do you think I can still sell the house? Please be honest with me I am welcoming any and all suggestions and advice opinions with open arms again thank you for your time today and I wish you many blessings today and always. I funded and recorded a loan as a second TD and I am positioned well considering the total LTV.  Payments on my subordinate lien are current and have always been on time.  I also regularly monitor the title activity to make sure the first TD is being kept current.  The owner has also recently place a third position TD<br />
<br />
My concerns/questions are:<br />
<br />
1. Should I give formal notice to the first and third TD holders of my lien?  Does anybody have a sample of what this notice looks like?<br />
2. Does the primary lien holder have a legal obligation to inform me of default if I don't give them formal notice of my recorded lien?<br />
<br />

The owner was initially looking to sell for 1.2 million then later mentioned they were open to leasing for monthly payments.<br />

I have the investors with the cash.<br />

The hardest part will be explaining seller financing to the homeowner.<br />
<br />
How should I structure the seller financing deal?<br />
<br />
I was thinking:<br />
<br />
Find an investor to fund the repairs and to provide a down payment for roughly $30,000 to the homeowner.<br />
<br />
The homeowner will deed the property over to the investor which will be covered by a promissory note that will guarantee monthly payments for a certain amount of time until the agreed upon amount is paid off.<br />

I just got back the recorded Affidavit of Death of Trustee from the recorder office in Orange County, Ca.  The assessor office called and inquired a copy of death certificate since they cant find it in the database.  So I called recorder's office and found out that they did NOT record the death certificate.<br />
<br />
The recorded Affidavit of Death of Trustee does have a barcode on top and so it's now a legal document.  Does certificate of death need to be recorded ?  Thank you for your help<br />

I have a unique situation.. So my parents owned a home where they roughly owed $50K. My dad had a bad stroke and they stopped paying it and it went into foreclosure... My parents have no assets here in the USA. The foreclosure went down in 2011-2012. Needless to say, my parents both have bad credit.<br />

My father has property in another country that we are trying to sell. Long story short.... How do I know if it is possible that if we sell the property that the money can be deposited into a bank account in his name here? He has a bank account here with my mom on it where only his social security goes (he is 77). Once a month my mom withdraws it. Other thank that activity, there is no other activity. He has an account in the other country that the money can be deposite to but I am just wondering how to find out if anything is up with his accounts here. They dont seem to be frozen.<br />

The MTG is at 10%.  Our house is worth less than half of what we owe.  It's falling apart, and it's time to leave.  We contacted SPServicing about a Deed In Liu.  They denied that and stated that it would be a foreclosure.<br />

            <description><![CDATA[ I had my home foreclosed on after applying twice for a short sale and being told I did not qualify for a deed in lieu of.  The house went up to auction and sold for 50,000.  I owed 75k. I went online and checked my credit report and it said that my 75,000 debt was dropped. Is that because the bank got 50k and will have to rework how much I owe? Will the new amount show up on my credit report?<br />

I got a check in the mail from the bank for $170 because of an error in reporting something to the IRS.  <br />

I wasn't sure if that had anything to do with my debt being cleared on the house but I highly doubt they just forgave my debt since I would still owe them $10,000 ish. <br />

Anyone have even an idea of what would cause the debt to be cleared?  It does not say on the site.]]></description>

            <description><![CDATA[ So i went into foreclosure status sometime in 2009. Not really sure because i moved out of the house and state and never received any mail regarding the foreclosure. So i really don't know much about the foreclosure at all beside it foreclosed. So i am now in the process of buying a new home using my Va benefits. I am to the point where our loan is going to underwriting. But my lender called and told me he ran CAIVRS and my foreclosure for that home is on that list. So i went on to the Otero County website and pull up the history of the home and found out the foreclosure didn't happen til 8/10/15. That was 7 years after i moved. So my question is how long does a bank have to file for the foreclosure and how can they keep my home buying privileges at a halt. I have submitted a Caivrs suppression with the hud people and just waiting on a answer from them but i am just wanting to know if it was right that they took 7 years to do the foreclosure.<br />

            <description><![CDATA[ I live in New York and a property near me has been vacant for many years, at least 6. I found the husband of the previous owners who has no contact with the EX wife and he said the bank ordered them to vacate and not return.  The bank basically stonewalled me, but eventually told me they have no interest in the property at this point.  The property has a large tax bill due as the bank and prior owners haven’t paid since 2014.  <br />

I want to buy this house before a tax auction, potentially thru a quitclaim.  How?  <br />

I want to confirm the bank has no interest, do I ask the prior owner to call the bank and give authorization to speak with me about it or is there another way as he probably won’t?  The discharge of mortgage is recorded with the county.<br />
<br />
The spouse is nowhere to be found, how do I work around this?<br />

What are the steps I need to take to buy this eyesore for our neighborhood?<br />

I'm in the middle of a mess my parents created trying to avoid foreclosure.  My mom ended up using Grant Deeds to transfer real property into a partnership consisting of her and three other individuals (they are named) and then it says each has 25% interest - yet the terms were &quot;no consideration&quot; or it was a bonafide gift.
